The Fair Work Agency (FWA) is the state regulator for the private recruitment sector and is responsible for seeking compliance with this legislation. They check for compliance by investigating complaints made by agency workers and conducting inspections of recruitment agencies.

   References to Employment Agency Standards (EAS) Inspectorate changed to Fair Work Agency (FWA). On 7 April 2026 a new government agency called the Fair Work Agency (FWA) began operating. It replaced the Employment Agency Standards (EAS) Inspectorate.
